AMENDMENT TO
REGULATION OF THE MINISTER OF TRADE
NO. 12/M-DAG/PER/6/2005
ON RULES ABOUT EXPORT OF RATTAN

THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering :

• a. that, in the framework of reduction of costs expended by exporters and increase of export, it is deemed necessary to restipulate cost of verification/technical investigation into export of rattan;
• b. that, concerning the matter as meant in paragraph a, it is necessary to amend Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 on Rules About Export of Rattan;
• c. that, based on the considerations as meant in paragraphs a and b, it is necessary to stipulate Regulation of the Minister of Trade;

In view of :

• 1. Presidential Decree No. 187/M/2004 on Establishment of United Indonesia Cabinet as already amended several times and latest by Presidential Decree No. 171/M/2005;
• 2. Presidential Regulation No. 9/2005 on Positions, Duties, Functions, Structures of Organization, and Operational Procedures of State Ministries of the Republic of Indonesia as already amended several times and latest by Presidential Regulation No. 62/2005;
• 3. Presidential Regulation No. 10/2005 on Units of Organization and Duties of Echelons I of State Ministries of the Republic of Indonesia as already amended several times and latest by Presidential Regulation No. 63/2005;
• 4. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on Organization and Operational Procedure of the Ministry of Trade as already amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;
• 5. Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 on Rules About Export of Rattan.

DECIDES:

To stipulate :

REGULATION OF THE MINISTER OF TRADE AMENDMENT TO REGULATION OF THE MINISTER OF TRADE NO. 12/M-DAG/PER/6/2005 ON RULES ABOUT EXPORT OF RATTAN.

Article I

Several provisions in Regulation of the Minister of Trade No. 12/M-DAG/PER/6/2005 on Rules About Export of Rattan are amended as follows :

1. The provisions of Article 7 are amended to become as follows :

" Article 7

(1) Every export of rattan by ETR must first be verified/technically investigated.

(2) The verification/technical investigation on export of rattan as meant in paragraph (1) shall be performed by an independent experienced surveyor appointed by the Minister of Trade.

(3) Result of the verification/technical investigation on export of rattan by the surveyor as meant in paragraph (2) shall be contained in a Surveyor's Report (LS), which is a supporting document of export manifest.

(4) Costs arising from the verification/technical investigation as meant in paragraph (2) shall be borne by the government.

(5) Rules and procedure for performance of verification/technical investigation shall be stipulated by the Director General of Foreign Trade of the Ministry of Trade. "

2. Paragraphs (2) and (3) are deleted so that Article 12 becomes as follows:

" Article 12

(1) Certificates of Registered Exporter of Rattan (ETR) already issued pursuant to Decree of the Minister of Industry and Trade No. 355/MPP/Kep/5/2004 are declared remain valid as long as they are not in violation with this Regulation.

(2) Deleted.

(3) Deleted. "

3. One (1) Article, namely Article 12A, is inserted between Articles 12 and 13 so that Article 12 A becomes as follows :

" Article 12 A

When this Regulation is valid, Decree of the Minister of Industry and Trade No. 359/MPP/Kep/5/2004 on Appointment of Surveyor To Perform Verification/Technical Investigation On Export of Rattan is revoked and declared invalid. "

Article II

This Regulation is valid from June 1, 2006.

For public cognizance, this Regulation is published by placing it in the State Gazette of the Republic of Indonesia.
